You will avoid getting a criminal conviction/record if:
  1. You plead guilty and convince the Judge or Magistrate to give you a section 10 non-conviction sentence; or
  2. The court finds you ‘not guilty’ after hearing evidence from both sides in a defended hearing or trial; or
  3. The court dismisses the charge(s) under the mental health grounds such as section 32 Mental Health (Forensic Provisions) Act.

If you’re ever in a position to talk to the Judge or Magistrate to respond to a question or wanting to say something in court, you must address the Judge or Magistrate as “Your Honour” before saying what you wish to say.

Be polite and do not talk over or interrupt the Judge or Magistrate. If your case is called, approach the bar table and address the Judge or Magistrate as “Your Honour”. Then mention your full name.
