What happens after I’m charged by police?
A charge occurs when you’re served with a ‘Court Attendance Notice’ (‘CAN’) by police. The CAN will outline when and where you must next appear in court to face the allegation(s). It will also outline the specific section of the legislation and brief outline of the allegations.
After receiving the CAN document, we’ll ask you to provide us this so that we can further advice and guide you in preparation of your next court date.
After being charged, you may be granted or refused bail. Our lawyers are available to appear in court to make urgent bail applications.

Will I go to jail?
A court is not allowed to sentence you to full-time jail UNLESS it’s first satisfied that after considering all alternative options to jail, that no penalty other than jail is appropriate.
The law requires a Judge or Magistrate to only use imprisonment as a sentence of last resort.

Do I have to write a good character and apology letter for court?
Preparing your court sentence with a strong good character letter and apology letter can significantly improve your chances of convincing the Judge or Magistrate to impose a lenient sentence.
As a result of using well written letter that address the important legal points can significantly increase your chances of avoiding a criminal record, and in more serious cases, avoid full-time imprisonment for serious offences.
