Drink Driving Offences in NSW

Drink driving is a criminal offence in NSW, and penalties vary based on your BAC range and licence type:

  • High Range: 0.15 and above – Heavy fines, lengthy disqualification, mandatory interlock program, possible prison sentence.

  • Mid Range: 0.08 – 0.149 – Significant fines, disqualification, mandatory interlock program, possible prison.

  • Low Range: 0.05 – 0.079 – On-the-spot fine and 3-month suspension for first offence, possible court election.

  • Special Range: 0.02 – 0.049 – Applies to L/P platers and interlock drivers.

  • Novice Range: Above 0.00 – 0.019 – Applies to L/P platers and interlock drivers.

  • DUI (Driving Under the Influence): No BAC reading required; offence can be proven by signs of intoxication.
